Agreement to terms

By creating a Navello account, accessing or using the Navello platform (including our website, mobile application, and any related services) (together, the "Service"), you agree to be bound by these Terms of Use (the "Terms").

If you do not agree to these Terms, you must not create an account or use the Service.

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the updated Terms.

Throughout these Terms:

• "We," "us," "our," and "Navello" refer to Navello Pty Ltd (ABN 78 691 881 526).
• "You" and "your" refer to you, the individual creating an account and using the Service.
• "Carer" refers to the account holder — the person who creates and manages a Navello account.
• "Care Recipient" refers to the person whose health and care information is entered into the Service by the Carer.

About Navello

Navello is an AI-powered aged care navigation platform. We help carers — typically adult children — find information about and navigate Australia's aged care system on behalf of their elderly parents or other loved ones.

Navello is an information and navigation service only. We are here to help you understand your options and point you in the right direction.

Navello is not:

• A health or medical service
• A financial advisory service
• A legal service
• A government service or agency
• A substitute for professional aged care advice
• An emergency or crisis service

We do not provide diagnoses, treatment recommendations, or clinical assessments. We do not make decisions about care. We help you understand and navigate the system — the decisions are always yours.

Eligibility

To create an account and use the Service, you must:

(a) Be at least 18 years of age.

(b) Be an Australian resident, or be navigating the Australian aged care system on behalf of someone in Australia.

(c) Have the legal capacity to enter into a binding agreement under applicable law.

(d) Create only one account per person.

Account creation and the carer/care recipient relationship

Navello is designed for a specific relationship: a Carer (you, the account holder) enters information about a Care Recipient (typically an elderly parent or loved one) so that our AI can provide tailored aged care navigation.

By creating an account and entering information about a Care Recipient, you represent and warrant that:

(a) You have a genuine caring relationship with the Care Recipient.

(b) You are acting in the Care Recipient's best interests.

(c) You will inform the Care Recipient that you are using Navello and that their health and personal information is being entered into an AI-powered platform.

(d) You understand that the Care Recipient's health and personal information will be processed in accordance with our Privacy Policy.

(e) You acknowledge that the Care Recipient has independent rights regarding their personal information. The Care Recipient may contact Navello directly at privacy@navello.com.au.

What Navello is not — AI limitations

Not medical advice

Navello does not provide medical advice, diagnoses, or treatment recommendations. If you have concerns about the Care Recipient's health, consult their GP or healthcare team.

Not a substitute for professional aged care advisers

For complex situations, seek professional advice. The Older Persons Advocacy Network (OPAN) can be reached on 1800 700 600.

Not legal or financial advice

Navello does not provide legal advice or financial advice. Consult a qualified lawyer or financial adviser.

Not a government service

Navello is a private company. We are not affiliated with, endorsed by, or connected to My Aged Care, the Australian Government Department of Health, Services Australia, or any other government body.

Not always right

Our AI can make mistakes. You should always verify important information with official sources before making decisions.

Not real-time monitored

We do not monitor your conversations with the AI in real time. If you or the Care Recipient are in danger or experiencing a medical emergency, stop using Navello and call 000 immediately.

Acceptable use

When using the Service, you agree to provide accurate, truthful, and complete information, keep your information up to date, and use the Service only for genuine aged care navigation purposes.

You must not use automated tools, attempt to reverse-engineer the Service, use prompt injection techniques, submit harmful content, or use the Service in any way that violates applicable law.

Intellectual property

You retain ownership of the content you provide. By using the Service, you grant Navello a non-exclusive, worldwide, royalty-free licence to use, store, process, and display Your Content for providing and improving the Service.

Pilot access and fees

The Navello pilot is provided free of charge for the duration of the pilot period. No subscription fees or payment information are required to participate.

Availability and changes

The Service is provided on an "as is" and "as available" basis. We may update, modify, add, or remove features with reasonable notice.

Account suspension and termination

You can delete your account at any time through account settings or by contacting support@navello.com.au. Deletion is processed within 30 days.

Limitation of liability

To the maximum extent permitted by law, Navello's total aggregate liability for any and all claims arising from the Service is limited to the greater of the amount you have paid to Navello in the 12 months preceding the claim or AUD $100.

Nothing in these Terms excludes any rights you have under the Australian Consumer Law.

Governing law

These Terms are governed by the laws of Queensland, Australia.
